Creative Commons Madagascar

First of all, I have to make this very public declaration: I am not a biologist, an economist, a model (!) and at this point not even a designer (I'm better …not). I've been spending 3 days doing what I wasn't supposed to do and what I fatally had to do : practicing very very very high level of Evangelism 2.0 and reaching so many different communities I came to the point of mixing names with blogs and mails. I was so exchausted (and lost) I had to refuse the traditional social expression of friendship and sympathy commonly used around Malagasy societies  : the very serious exchange of phone numbers and business cards. This journey inside a new dimension started when a popular Malagasy website used one of our bloggers' videos on his frontpage to raise funds for the same cause (right!) but "forgot" to put his sources. Of course we reacted as violently as the webmaster showed some resistance or let's say …stupidity and won our cause. The experience renewed so many times in so different scales, we brougt the case to our great editor at Rising Voices, Rezwan, who posted and explained the challenges and necessity to promote CC Licences around internet and…and our très très third world communities.

Creative Commons and the culture of sharing

So it was all about CC Licences when I climbed Peel st. in Montreal and sneaked inside Pr Tina Piper's office to grab the HUGE envelop she left for me. Free stuffs.Eventually I had to re-learn everything on the subject of my crusade on my 24hour plane to Mada and forgot everything about it on this cold september afternoon at AFT. So here we are, Pakysse-the-sicko and little purple facing the future of Madagascar law practictioners. oh my. We're dead. We did so right this morning and yesterday and the day before, always getting the final words and the promise of collectively creating the best community in the world. Why was I this naive? They're doing this to every tourist in town, they show sweetness but wait a little longer…

Numérisation, mise en ligne et droit d’auteur

Tous droits réservés, reproduction interdite sans autorisation des éditeurs et puis en face la numérisation, la diffusion en ligne et la copie sur CD, il est très facile aujourd’hui de passer outre la protection légale des oeuvres de l’esprit.

Par la numérisation, la “Collection des ouvrages anciens concernant Madagascar” est conservée. Tout le monde s’en réjouit. Mais comment en assurer la diffusion indispensable à la valorisation ? Le problème est complexe. L’ouvrage étant un recueil de publications commentées et annotées, il est difficile de savoir si Alfred Grandidier et al. sont des éditeurs ou des auteurs ; dans la notice ils sont cités auteurs-éditeurs, mais vis-à-vis de la loi leurs héritiers peuvent-ils jouir du droit d’auteur ? Alfred Grandidier est mort en 1921 ; son oeuvre appartient donc au domaine public mais il a eu des collaborateurs dont son fils Guillaume mort en 1957.

La loi malgache no 94-036 portant sur la propriété littéraire et artistique autorise la reproduction isolée d’une oeuvre sans l’autorisation de l’auteur par les bibliothèques et services d’archives dans certaines conditions, mais la mise en ligne peut-elle être considérée comme une reproduction isolée ? Cela impliquerait que la consultation du livre en ligne ou la diffusion du CD, le cas échéant, doivent-etre rigoureusement controlées.

En effet en cas de piratage et autres utilisations illicites, le projet non seulement ne pourrait pas revendiquer le droit de poursuite mais pire il pourrait etre accusé.

 

Rights and Pictures was the topic's of today's debate at AFT ( i forgot about the theme but it has been very largely chronicled by our best editorialist in town, you know,…the guy who still think we're in 6th century and have kings. this one from . yes, him) So we were there trying to be the best listeners and understand the goals of this presentation. Rights on Images, Images have rights, public rights, Tantely who stole money (To you missed this great part!), and there we were : Nothing about Internet!! We're in 2008, right? I asked Pakysse who was already playing the MC and explaining some weird stories on zebu and ministers on the bus and rights and pictures and internet. I thought I could use this god given opportunity to "filer a la douce" but he was already pointing me and my stickers…I'm done. We're dead.

As you may have noticed, I survived.Great people gave me their contacts.meeting a very powerful community of artists this week (forgot their names but not their mails).noticed smart kids in the room who were smart enough to get the stickers (they had Creative Commons website on). would also take this opportunity to thank Renata Avila who was soooooooooo coool to support me with tips, and "I know", "I know", and advices after this traumatizing experience.  Creative Commons community ! you're my angels!

    tomavana>oh my. you have no idea how …this debate was. we were sent there by AUF very activist teacher bright open source software developers who was very convinced that our presence there was highly required for the sake of Malagasy online community survival.oh my. we had no idea we were about to make more ennemies than friends among those Law students. I have the video of Gentil professor inviting us and Grumpy AFT moderator snobbing us.

I mean , we are part of CC Licences organization and working intensively with the international team to make the best strategy ever. but nationally speaking, locally I mean,…., We’re going suicidal! I already have few jurists names but would love to get more from this special specie on our side.
